Banebrydende spændende nyt om Købeloven

EU-Kommissionen har lagt op til, at handel med levende dyr skal udgå af reglerne om forbrugerkøb, hvilket sandsynligvis betyder, at den danske købelov på dette område føres tilbage til de regler, der var gældende før 1999

Den danske købelov indeholder i dag et afsnit, der tildeler forbrugere en udvidet beskyttelse sammenlignet med erhvervsdrivende købere, og disse regler blev indført som følge af forbrugerdirektivets vedtagelse i 1999 i EU.

De store organisationer World Breeding Federation for Sport Horses og European Horse Network har lagt et stort arbejde i at påvirke Europakommissionen til en direktivændring omkring lovgivningen om handel med levende dyr, og det viser sig nu, at lobbyarbejdet har båret frugt. Den 20. februar 2018 foreslog EU-Kommissionen, at handel med levende dyr helt skal udgå af reglerne om forbrugerkøb.

Kort udsigt til lovændring

Det vurderes, at direktivforslaget vedtages af EU-Parlamentet inden for seks måneder, og som en følge af direktivets vedtagelse antages det, at den danske købelov ændres, så afsnittet om forbrugerkøb helt undtages handel med levende dyr.

– Det er en meget opløftende nyhed, der kan få stor betydning for dansk hesteavl. Mange avlere har siden 1999 mistet lysten og modet til at avle, da købeloven i mange tilfælde har medført store økonomiske konsekvenser for sælgerne, som ofte er avlerne, sig formand for Dansk Varmblod, Jan Pedersen.

Jan Pedersen er også formand for den internationale paraplyorganisation for 75 ridehesteavlsforbund, WBFSH (World Breeding Federation for Sport Horses), som er en af hovedaktørerne, der har arbejdet målrettet for at påvirke EU-Kommissionen til en direktivændring.

Tilbage til tidligere regler

Ændres den danske købelov, så afsnittet om forbrugerkøb helt undtages handel med levende dyr, bliver retsstillingen formentligt den, at salg af levende dyr – uanset om det er til forbrugere eller erhvervsdrivende – alene omfattes af de regler, som var gældende forud for forbrugerdirektivets vedtagelse i 1999.

Det antages videre, at en sælger i forbrugerkøb blandt andet vil kunne aftale, at sælger ikke skal bære risikoen for fx skjulte mangler. Denne mulighed vil i praksis have stor betydning, eftersom det på nuværende tidspunkt ikke er muligt for sælger i forbrugerkøb at fraskrive sig sit ansvar.

Endvidere vil den såkaldte ’omvendte bevisbyrderegel’ udgå. Det betyder konkret, at det er køber, der skal bevise, at hesten er mangelfuld, uanset om manglen viser sig inden for de første seks måneder efter levering til køber.

Forbedret retsstilling for sælger

Endeligt ændres reklamationsfristen således, at det bliver muligt for sælger at indgå aftale med køber om, at køber har en kortere absolut reklamationsret end den nugældende på to år. Således bliver det fx tilladt at aftale, at køber alene kan reklamere over mangler, såfremt reklamation sker inden udløbet af fx tre måneder efter levering. Det skal dog præciseres, at såfremt sælger har tilbageholdt oplysninger, da vil sælger ikke kunne afskære køber fra at reklamere og dermed ej heller sit ansvar, uanset om parterne har aftalt en tidsbegrænset reklamationsfrist.    

Overordnet kan det altså konstateres, at en vedtagelse af direktivforslaget sandsynligvis vil tildele sælger af levende dyr en større aftalefrihed i forbrugerkøb end hidtil, ligesom sælgers retsstilling i en række andre henseender forbedres.

The 35 best Danish Warmblood Young Horses, 5 year old qualified regional during last autumn, and the 24 best from the first two days at Herning went on to test riding by Patrik Kittel. 15 horses Saturday and 9 Sunday to be tested. 

It was a very educational, talking and positive Kittel in the saddle of the young horses, and he gave both the audience and the horses some very good time at Boxen arena. 

In total Kittel gave a clear 10 five times when testing the 24 horses. 

In front and outstanding all the way

The big impressive top mover Zhaplin Langholt by Glock´s Zonik / Stedinger presented by Andreas Helgstrand stood out from the start to the final. And it was also obvious when Kittel got in the saddle that the gelding just did everything he was asking for and at the same time with top qualities. Well deserved 10 for both ride ability and potential and overall clear winner. 

"That was really a pleasure to do, I have to say"

Day 1 at the test riding the mare Atterupgaards Mildura DWB by Blue Hors Zack / Lord Sinclair presented by Carina Cassøe Krüth gave Patrik Kittel the best feeling, and he gave her a 10 for ride ability. After the testing Kittel said: "I have to say this horse gave me everything I want in a test riding, it has everything walk, trot and canter, ok it could reach a bit more for the trot. It has a quick explosive trot, fantastic in the hand, I gave her a 10 for ride ability".

10 for ride ability and 10 for potential

Day 2 with words of praise from test rider Patrik Kittel about Delizia by Fürstenball / De Noir ridden by Anne Troensegaard. 

"Nice contact, good light search for the hand, trot through the body, nice hot for the canter. Fantastic horse for the future, OMG".

At the same time Kittel appointed Delizia as the most happy horse.

Classic Briolinca and Gareth Hughes wins CDI3 Grand Prix at Keysoe, GBR

Gareth Hughes showing a very nice balanced test, with just some minor issues, where the walk tour becomes with some tensions, and the subsequent piaffe also is shown with some tension. The overall impression is a very nice a easy picture. 

Fiona Bigwood and her newly purchase 14 year old Danish Warmblood Kjærholms Abutsiaq by Michellino made their international debut with a 3rd place. No major errors, but lacking yet more fine tuning for the piaffe tours and transitions. Nice expression for the trot tour, good walk and nice series and good sit for pirouettes, 2nd pirouette becomes bit unbalanced out. Best piaffe with good transition out at the final centerline. 

Best placed Danish combination is Ulrik Mølgaard with his Michellino son Michigan - they were placed as no 8 with 67,674%. Nice power for the trot tour. Super walk tour. The first piaffe lack more flow and go, and unfortunately an error at the end of the one times.

Danish Anders Dahl and Sir Donato finished as no 10 with 65,696%. Nice trot tour, the first two piaffe tours are very much forward. A small error in the mid of the one times. Both canter pirouettes becomes a bit unbalanced.

CROSBY - Highlight for the up coming Van Olst Sales 30th March

Talented quality 3 year old youngsters are ready for the auction, and at the same time the collection also contains a couple of more educated horses. Among them one of the highlights is the 7 year old approved stallion Crosby.

He has already proven himself at the competition arenas and shows the potential for the future. For sure Crosby can fulfull your dreams.

Crosby is a seven-year-old NRPS-approved stallion. Last year Crosby was amongst the top five of the six-year-olds during the Pavo Cup. As a result he was selected for the qualifiers for the World Championship for Young Dressage Horses. He displays a beautiful technique, performs very beautiful flying changes and excels with his correct attitude. Sire Chippendale is a son of the charming Lord Leatherdale. On his dam’s side Chippendale goes back to the famous preferente Negro and the Oldenburg top-producer Landadel. Chippendale’s dam, the elite sport-(dr) mare Ti Amo, is also well-known for being the full-sister of the successful Small Tour horse Strous.

Some confusion about the ranking after the CDI3 Grand Prix freestyle at Herning Sunday

When sitting at the arena watching the freestyle and saw the final results came up first without third placed German Bernadette Brune with Lights of Londonderry, and then some minutes later including her at the scoreboard, it of course made some confusion about what was really going on. 

The fact is that Bernadette did not show up to the subsequent pricegiving, and according to the FEI rules you must take part in the pricegivning when placed as this is also a part of the competition, otherwise you will be disqualified.

Instead Danish Mai Tofte Olesen with Rustique stepped up and got the last placement as no 5 in the Grand Prix freestyle, unfortunately without being celebrated by her home crowd.

Charlotte Dujardin with MSJ Freestyle and Carl Hester with Hawtins Delicato ready for CDI3 Grand Prix debut

Very exciting entry list for Nieuw en Sint Joosland, NED taking place from 3rd-8th April.

Besides Charlotte Dujardin and Carl Hester debut at Grand Prix level with MSJ Freestyle and Hawtins Delicato, also British Fiona Bigwood will show her two new horses Danish Warmblood gelding Kjærholms Abutsiaq and Pin Rock´s Foxfire Blitz.

It will also be international debut for Hans Peter Minderhoud with KWPN stallion Glock´s Dreamboy, like Blue Hors rider Danish Nanna Merrald with Sådan Que will make their international debut at senior Grand Prix level.

While most of the Danes and a lot of entusiastic breeders were together at Danish Warmblood stallion show, the last leg of this season´s World Cup series took place at s´Hertogenbosch. 

Here the Queen of dressage Isabell Werth took another great victory in both the Grand Prix and the Grand Prix freestyle, while Dutch Edward Gal and his Danish Warmblood stallion Glock´s Zonik were placed 2nd both days.

Dansk Varmblod havde i samarbejde med Zibrasport etableret et lille studie under tribunen i boksen, hvor studieværten Louise Hededam, fra torsdag til søndag to gange dagligt, havde en lang række personer i sofaen til en snak om alt omkring hingstekåringen i Herning.

The three times world champion, Fiontini has just returned from participating in the prestigious gala show during Herning Horse Show. She was honoured together with Helgstrand's Spanish top rider, Severo Jurado López, for their winnings at the World Championships for Young Horses in Ermelo. The successful mare will continue to stay at Helgstrands, but now changes the owner to Stutteri Evo and Helgstrand Dressage.

The three times world champion, Fiontini by Fassbinder/Blue Hors Romanov, who in October 2016 was bought by the Swedish rider Beata Söderberg, has now been bought in partnership by Stutteri Evo in Vejen, Denmark and Helgstrand Dressage in Vodskov, to ensure a horse towards Olympic Games in Tokyo 2020.

- There is hardly any doubt that Fiontini is a special horse and that she has all the qualities needed to compete internationally. For three years, she has shown her great capacity at the World Championships for Young Horses and we are sure she has what it takes to get in the top when it comes to the Olympics in the summer of 2020, says Andreas Helgstrand.

Most people know this special mare, who have had a unique partnership with Spanish, Severo Jurado López, in recent years.

- We are delighted that Fiontini is staying at our place and for now the plan is that Severo will continue her training. The two are a fantastic match and we have great expectations for their common future, says Andreas Helgstrand.

Fiontini solgt til Stutteri EVO og Helgstrand Dressage

Den tredobbelte verdensmester, Fiontini er netop hjemvendt efter at have deltaget i det prestigefyldte gallashow under hingstekåring i Herning. Her blev hun hædret sammen med Helgstrands spanske toprytter, Severo Jurado López, for deres sejre ved unghesteverdensmesterskaberne i Ermelo. Den succesfulde hoppe bliver i samme stald, men skifter nu ejer til Stutteri Evo og Helgstrand Dressage.

Den tredobbelte verdensmester, Fiontini (Fassbinder/Blue Hors Romanov), der i oktober 2016 skiftede ejer til den svenske rytter, Beata Söderberg, er nu købt i partnerskab af Stutteri Evo i Vejen og Helgstrand Dressage ved Vodskov, for at sikre en hest frem mod OL 2020 i Tokyo.

"Der er vist næppe nogen tvivl om, at Fiontini er en hest i særklasse og at hun besidder alle de kvaliteter, der skal til for at være med i verdenseliten. Hun har tre år i træk vist sit værd til unghesteverdensmesterskaberne og vi er sikre på, at hun har det der skal til, for at blande sig i toppen, når det kommer til OL i sommeren 2020," fortæller Andreas Helgstrand. 

Hoppen, som de fleste kender og som har været på manges læber, har de seneste år haft et unikt makkerskab med spanske, Severo Jurado López.

Curious to see the young stallions invited for 10-day testing at Danish Warmblood under saddle (video)

Sunday afternoon the approved stallions were inspected for a 10-day observation test prior to the upcoming breeding season.

The stallions are lightly ridden at the test where they are being observed for rideability, temperament and stable vices. Only if the 10-day observation test is passed with a satisfactory result, the stallion may proceed to carry out breeding duties this year and must return to the stallion licensing next year for a new approval.

H2R caught most a small impression from most of the stallions for the 10-day observation test.

This weekend at home soil at CDI3 event at Herning, during Danish Warmblood stallion show Daniel Bachmann Andersen showed a very motivated and fresh Blue Hors Don Olymbrio for the big tour Grand Prix and Grand Prix freestyle. Both classes they came 2nd to the very experienced Russian combination Mister X and Inessa Merkulova. 

They showed a nice and smooth Grand Prix test with no major errors, and just lacking a bit more strength and security for piaffe tours and pirouettes, but still scoring very nicely.

21 dressage youngsters approved for testing at Danish Warmblood

At the Danish Warmblood Stallion Licensing in Herning 21 dressage stallions and 10 show jumping stallions in the group of untested stallions were approved Sunday afternoon. 11 became premium stallions

Group I at the Danish Warmblood Stallion Licensing consists of stallions that have not yet passed a performance test and these youngsters are predominantly 3-year-olds. In the past, the Danish Warmblood breeding committee appointed a champion stallion in each discipline, dressage and show jumping, but in order to avoid too much focus on one untested young stallion the procedure has changed. The best individuals of the collection are appointed as premium stallions, but not no champions are named.

This year the judges found the quality of the young stallions very high, and hence a total of 31 were approved –21 dressage stallions and 10 show jumping stallions out of which seven dressage stallions and four show jumping stallions were awarded premium.

On Sunday afternoon at the grand final of the Danish Warmblood Stallion Licensing the audience and the judges witness an unusually strong collection of 4-year-old stallions

Among the dressage as well as the show jumping stallions there are certainly prospects not only for the FEI/WBFSH World Championships for Young Horses but also future FEI horses with an international show career.

Whereas no champion stallions are appointed in the group of 3-year-olds, two (dressage and show jumping) champions are appointed among the 4-year-old stallions. Here the title winners as best Danish-bred dressage and show jumping stallions are also named and decorated with the Aage Ravn and Elvin Rasmussen challenge trophies.

The performance test winner in show jumping, Fidelio Ask was appointed champion stallion and winner of the Elvin Rasmussen challenge trophy as well as he was decorated with a breeder medal of silver.

In the dressage ring of unusual high quality, the Swedish-bred Springbank II VH, a superior performance test winner, claimed the champion title and was praised by the judges as an extremely attractive and talented stallion. 

Best Danish-bred dressage stallion, the highly elegant Blue Hors Zack received the Aage Ravn challenge trophy and a breeder medal in gold. Thereby, Blue Hors Zack is the 7th stallion in Danish Warmblood’s history to be decorated with the coveted gold medal.

Danish Warmblood Stallion of the Year 2018

One of the highest awards a stallion can obtain in Danish Warmblood is the coveted title Stallion of the Year. This year the prestigious title goes to 12-year-old Fürstenball

Spokesman of the breeding committee, Claus Hansen, introduced the Stallion of the Year with these words:

– He is still one of the most used stallions in Europe. He is immensely true to type, has a superior interior and excellent basic gaits which are assetts that he with great certainty passes on to his offspring. He is known worldwide for putting an eye-catching quality mark on all his offspring. There is no doubt that he is one of the stallions that have always had and always will have the breeders’ attention and interest.

– In Denmark alone, he has sired more than 400 offspring and in 2017 he received the Danish Warmblood quality label, Elite Stallion. For several years he has been top placed in both the Danish and the German breeding index values for dressage.

Fürstenball by Fürst Heinrich / Donnerhall (bred by Georg Sieverding) is co-owned by Lone Bøgh Henriksen of HP Horses and Paul Schockemühle of Hengsthaltung Schockemühle. Unfortunately, Fürstenball is not able to be present in Herning this year, but a short video about Fürstenball was shown on the big screen.

As the visible proof of the title as the Stallion of the Year 2018, Danish Warmblood's chairman Jan Pedersen presented the statuette donated by former chairman Peder Hostrup Pedersen, along with a painting of the stallion.

– I hope that everyone associated with Fürstenball will be delighted with the statuette's unconditional symbol for this remarkable achievement, Claus Hansen concluded.

Werth wins and Gal glitters as Final line-up is decided in Den Bosch

Young horses shine on thrilling afternoon; six WEL nations will be represented in Paris

With the biggest smile on her face that said it all as she strutted down the centreline for the final time, defending series champion, Germany’s Isabell Werth (48), nailed her fourth win of the season at the last qualifier of the FEI World Cup™ Dressage 2017/2018 Western European League in ’s-Hertogenbosch, Netherlands today. On an afternoon when many of the early starters were hampered by spooky moments in the ring, the second-half contestants really raised the bar, and once Werth and Emilio took their turn when fifth-last to go, her score of 87.405 would be the winning one.

They weren’t the only partnerships to bring the crowd in the Brabanthalle to their feet however, as home runners Edward Gal (48) and Glock’s Zonik got the same treatment when slotting into second on 83.900 following a great test. And, last in, compatriot Madeleine Witte-Vrees (45) and Cennin posted 82.555 to demote Germany’s Jessica von Bredow-Werndl (32) and Zaire-E to fourth place. The packed stadium of spectators enjoyed a real treat in the closing stages, but it was all about Isabell once again as she marches towards the 2018 FEI World Cup™ Dressage Final in Paris, France next month to chase down her second successive title and her fourth overall. 

She has rarely looked more happy and confident throughout the extraordinary career during which she has become the most medalled athlete in equestrian sport. And with two wins from her superstar Olympic ride Weihegold and another two from Emilio who was at his very best today, her horses are also in the form of their lives this winter. Weihegold the wonder-mare is of course her first choice for the Final, but Werth was thrilled with her 12-year-old gelding whose presence in the ring seems to grow with every outing. Pinned back to second place in Gothenburg, Sweden two weeks ago he stepped it up even more this afternoon. 

"Emilio certainly showed an improvement today, he was amazing, he felt like 90%!"

Another with a big smile at the end of his ride was 2010 champion Gal who can’t help but be excited by the rapid development of his fabulous 10-year-old stallion, Zonic, whose trot extensions drew gasps of delight from the crowd.  

"“He’s improving so fast, this was only his third World Cup! There are a few little things that need improving, but he keeps surprising me!”

The 2018 Final will be another big test for this lovely young horse, and the Dutch are looking stronger by the day, with Witte-Vrees’ stallion Cennin still only 11 and also looking mature beyond his years. 

Today’s result has decided the Western European League qualifying spots for the Final which takes place from 11 to 15 April at which nine riders from six nations - Austria, Denmark, Germany, Great Britain, Netherlands and Sweden - will do battle with the rest of the best in the world. Britain’s Emile Faurie just squeezed into equal-eighth place despite having to withdraw from today’s competition with his gelding, Lollipop.
